For those following the consumer protection class action lawsuit against Whole Foods Market for falsely and misleadingly promising “No Antibiotics, Ever” for the meat it sells, we’re happy to report that the Second Amended Complaint is on file and that Whole Foods has filed its answer. We’re continuing into the discovery (further investigation) phase of the case.

We filed a consumer class action against Whole Foods for misleading shoppers about whether its beef is truthfully an antibiotic free product. Thanks to Forbes for covering the suit.

Score one for consumers in the poultry false advertising cases! The Courthouse News Service, among others, reported on the win for consumers in Cohen v. Conagra. I argued this case in September and the Ninth Circuit Court of Appeals ruled in under two months to send the case back to the trial court. This week my team and I filed a consumer class action against Diestel Turkey Ranch in federal court in New Mexico for deceiving consumers. Diestel’s own documents show that less than 1% of the birds it raises and sells match the way it has advertised the turkeys. The undercover video and Diestel’s own vet records are evidence that birds in Diestel’s care do not live the life that Diestel promises consumers. We have also filed a consumer class action in California federal court to hold the company accountable.

New Mexico voters, you can now request your 2020 General Election absentee ballot online and it will be mailed to you. Request it as early as possible to allow the county clerks time to process and mail all the ballots. Click here!

Send me a photo of the package that has the USDA stamp and establishment number in small print (starts with a letter and then numbers), and I'll tell you where the meat or poultry product was packaged. This morning a masked man from Lettuce, Etc. delivered this to my doorstep. Local, fresh, small business feeding the community, it brightened my whole day to see this kind of entrepreneurship succeed.
